Where the child lived with a parent or guardian for six months prior to proceedings.

If your child has moved frequently in the past six months it is important to document a timeline of where, when and why. Establishing proof of jurisdiction is an important step so child custody determinations can be enforced. There are times that temporary emergency jurisdiction but only when the child is physically present, abandoned or subjected to mistreatment or abuse.

History

The UCCJEA is intended as an improvement over the UCCJA.

The update was made to reduce interstate conflicts and give a standard of processes to follow. They conform to the Federal Parental Kidnapping Prevention Act (the PKPA) to give interstate enforceability of orders and protections for domestic violence victims that move out of state for safety reasons (safe haven).
